AlterNet Takes on Shock Jock Michael Savage and Gets Threatened With a Lawsuit

When we helped publicize the link between bilious talk show host Michael Savage and Rockstar energy drink, we got a letter from their lawyers.Michael Savage, right-wing crusader against gays, immigrants, Muslims, Barack Obama, Britain, women, (and possibly puppies), may have found a new object for his wrath: groups that have the temerity to publicize the vicious talk-show host’s connection to Rockstar energy drink -- and to call for a boycott by consumers opposed to Savage's hatemongering.
As part of AlterNet's 10 Hottest Campaigns section, we published a piece alerting readers to a boycott against the Rockstar products. The campaign, launched by Charles C.C. Tsai on Facebook, brought attention to the connection between Savage and the energy drink company. Tsai's page pointed out that Savage's son, Russell Weiner, is the founder and CEO of Rockstar. Savage's wife serves as director of energy drink company, and Savage Productions shares an address with Rockstar(!).
On May 27, the same day the piece was published, Rockstar’s lawyers sent AlterNet a letter accusing us of defamation. The letter read, in part:
Mr. Savage is not affiliated with Rockstar in any manner. Alternet.org’s use of the article to tie Rockstar to Mr. Savage’s statements is wholly improper. Not only does it place Rockstar in a false light, but it constitutes defamation, both of which are objectional.
The offices of Glaser, Weil, Fink, Jacobs, Howard & Shapiro, also demanded an "immediate public retraction of these statements and an apology in substantially as conspicuous a matter on AlterNet.org as the defamatory statements were published."
So, we "apologized," sort of. Here’s what we said:
Lawyers from Rockstar have written AlterNet threatening to sue us because they claim that Michael Savage (aka Weiner) is not a "co-founder" of the Rockstar drink company, as was described in our item, but rather his son, Russell Weiner, is the CEO and principle shareholder, and that Savage has never been an officer, director, employee or shareholder, of the company. AlterNet does not have any specific knowledge of family discussions, meetings, etc., that led to the formation of the company to be able to prove that he was a "co-founder."
Nevertheless, a dictionary definition of "co-founder" offers: "to establish or found in concert with another or others." Thus, it would require, perhaps, for Savage and his son to deny they ever spoke about the founding of the company in order for Savage to be unqualified as a founder. The definition of co-founder doesn’t necessarily have anything to do with ownership, shareholding, etc.
That being said, in the absence of proof of the inner workings of the Weiner family, we retract the comment that Michael Savage was a "co-founder" of the beverage company and offer apologies, if somehow that characterization casts aspersions on any members of the Weiner family, or Savage himself.
Others have also been compelled to write retractions and say “I'm sorry." Gaywired, which published a story about TheTruthAboutRockstar.com, issued this statement.
Meanwhile, Tsai and his Facebook group fared far worse after taking on Rockstar and Savage:
"I made a group to let others know and be able to make a similar choice if they wanted; the group was formed, and it quickly grew to over 12,000 members." Tsai, says in a statement. “In it, we put together a list of quotations from Michael Savage Weiner, as well as his son, that we strongly did not agree with."
Tsai continues:
Tsai was then treated to a letter from Rockstar's lawyers similar to the one sent to AlterNet, telling him to issue an apology. Here are parts of Tsai's statement:We also put commonly known information, such as the fact that they co-founded the extremely conservative Paul Revere society, which openly calls for actions such as “eliminate bilingual education in all states" and "traditional marriage." More easily proven information was included as well.
Then, on May 27, I woke up unable to log into my personal Facebook account. It was disabled. I lost all my photos, friends and priceless memories. I sent multiple e-mails to Facebook without any response. And then upon inquiring, I found out that the "Don't Drink Hate. BOYCOTT ROCKSTAR" Facebook group was coincidentally also suddenly taken down without my or any of the administrators' knowledge.
I've been forced to make "an immediate public retraction..." and "apologize for the business libel you committed against Rockstar."
I've been "advised that Rockstar will pursue all necessary legal action to redress the violations of its rights, including, without limitation, an action for general, special and exemplary damages and equitable relief."

I apologize that I created a group as a means to explore my FREEDOM OF SPEECH.

I apologize that you seem to be confused by the semantics of the word "co-founder" in the sense that Michael Savage Weiner and his wife, Janet Weiner, IRREFUTABLY CO-CREATED / CO-INVENTED / CO-FOUNDED the Rockstar drink alongside current CEO RUSSELL WEINER.

On top of all that, the group's Facebook page was hijacked by Savage supporters. Yesterday, we received a Facebook message letting us know that, "Jan Mikael Evertsson changed the name of the group 'ROCKSTAR ENERGY DRINK FANCLUB!' to 'Michael Savage -- the FUTURE of America!' "
Since then, a different Facebook user has relaunched the "Don't Drink Hate. BOYCOTT ROCKSTAR" page on Facebook. The page reads:
REPOST BY ANOTHER USER BECAUSE THE ORIGINAL WAS HIJACKED: I AM NOT THE ORIGINAL ADMIN/CREATOR OF THIS GROUP, BUT I FEEL IT DESERVES TO BE PUT BACK.
NOTE: INVITE ALL THE ORIGINAL MEMBERS YOU CAN! WE NEED TO GET THIS BACK TO THE NUMBERS THE ORIGINAL HAD. IF THIS ONE GETS HACKED/REMOVED, THEN SOMEONE PLEASE CREATE ANOTHER, AND SO ON. YOU CAN'T STOP THE SIGNAL. AND I WILL OFFER NO RETRACTIONS AND NO APOLOGIES. FREE SPEECH IS UNIVERSAL. LIVE WITH IT, WEINERS...
Suing Runs in the Family
An eagerness to sue seems to run in the family. When Savage joined Fred Phelps on Britain’s "least wanted," a list of hatemongers banned from the country, he filed a lawsuit in Britain accusing the home secretary, Jacqui Smith, of "serious and damaging defamatory allegations,"
(Savage’s stand for the right to free speech, however, rings somewhat hollow, considering that the talk-show host has advocated jailing war protesters.)
Then there was Savage’s ill-fated (or not, considering the level of publicity it garnered) campaign against the Council for American-Islamic Relations (CAIR). In 2007, Savage accused CAIR of violating copyright laws by posting a 4-minute audio clip from Savage’s show. Savage also absurdly alleged that CAIR violated racketeering laws, “claiming that CAIR was a part of a criminal conspiracy silence critics of Islam," according to city media law. Not suprisingly, a federal district court in California dismissed the ridiculous lawsuit.
Apparently, these days, it is not enough for crazy right-wingers to intimidate through the airwaves. They also do so by threatening absurd lawsuits.
As for Rockstar: At this point, the company has become affiliated with Savage just by virtue of having engaged in similar intimidation tactics. Consumers deserve to know about the political affiliations of the products they buy. Or in this case, the horrifying hate speech associated with something as seemingly benign as an energy drink.
But in its campaign to muzzle critics, Rockstar has overplayed its hand; now, tens of thousands of new people will learn about its link to vicious hate-mongerer Michael Savage.

June 2, 2009— In a lengthy May 28 tirade on the Rob, Arnie & Dawn in the Morning radio show heard in Sacramento, California on KRXQ 98.5 FM and Reno, Nevada on KDOT 104.5 FM, hosts Rob Williams and Arnie States verbally attacked transgender children. While discussing a recent story about a transgender child in Omaha, Nebraska and her parents’ decision to support her transition, the two hosts spent more than 30 minutes explicitly promoting child abuse of and making cruel, dehumanizing and defamatory comments toward transgender children.

ROB WILLIAMS [11:12]: This is a weird person who is demanding attention. And when it’s a child, all it takes is a hug, maybe some tough love or anything in between. When your little boy said, ‘Mommy, I want to walk around in a dress.’ You tell them no cause that’s not what boys do. But that’s not what we’re doing in this culture.
ARNIE STATES [13:27]: If my son, God forbid, if my son put on a pair of high heels, I would probably hit him with one of my shoes. I would throw a shoe at him. Because you know what? Boys don’t wear high heels. And in my house, they definitely don’t wear high heels.
ROB WILLIAMS [17:45]: Dawn, they are freaks. They are abnormal. Not because they’re girls trapped in boys bodies but because they have a mental disorder that needs to be somehow gotten out of them. That’s where therapy could help them.
ROB WILLIAMS [18:15]: Or because they were molested. You know a lot of times these transgenders were molested. And you need to work with them on that. The point is you don’t allow the behavior. You cure the cause!
ARNIE STATES [21:30]: You got a boy saying, ‘I wanna wear dresses.’ I’m going to look at him and go, ‘You know what? You’re a little idiot! You little dumbass! Look, you are a boy! Boys don’t wear dresses.’
ARNIE STATES [29:22]: You know, my favorite part about hearing these stories about the kids in high school, who the entire high school caters around, lets the boy wear the dress. I look forward to when they go out into society and society beats them down. And they end up in therapy.
To her credit, co-host Dawn Rossi stood up to Williams and States during the segment.
Despite her apparent lack of familiarity with transgender issues, Rossi repeatedly defended transgender people and made an on-air apology for her colleagues’ defamatory remarks.

GRITtv: Michael Savage Cries Defamation

If you were hoping right wing talk radio host Michael Savage might move to London, you’ll be disappointed to learn they won’t have him. The British Home Office released what it called a name and shame list recently, dentifying 16 of the apparent 101 people who are barred from entering the country under strengthened travel laws adopted after the July 7, 2005 subway bombings. The Home Office described Savage as “seeking to provoke others to serious criminal acts and fostering hatred which might lead to inter-community violence.”
Others on the list include a former member of the Palestine Liberation Front, a Saudi Arabian Religious scholar, and a Pakistani cleric. The Rev. Fred Phelps, a pastor in Kansas, and his daughter were also on the list and barred for “fostering hatred.” Phelps is known for never missing an opportunity to preach against the LGBT community.
It’s tempting to cheer the British government’s decision to keep some of these undesirables out, certainly to call them out. But it raises a number of disturbing questions, of course, and could be used to bar anyone the government dislikes. Where do you draw the line? It’s an age old question.
What isn’t a question is that Michael Savage is a hypocrite. Endlessly defaming just about anyone he doesn’t like, Savage has said he’s considering a lawsuit against the British home secretary for, ahem, defamation. Yeah, good luck with that.

Op-ed in Chicago Sun-Times Voices Need for Inclusive Hate-Crime Legislation
The Chicago Sun-Times published an opinion piece reflecting on the prevalence of hate crimes against LGBT people at the 10-year remembrance of Mathew Shephard's murder. In his October 17 op-ed, "Expand hate-crimes law to cover transgender people," Ricky Garcia, the Public Policy Director of Equality Illinois, highlights the dangerous lack of comprehensive federal and statewide hate-crime legislation. Garcia draws upon his personal experience working in Illinois, and speaks to the need for gender identity to be included in the state's hate crimes law, which currently only encompasses sexual orientation. Most brutal attacks in the state have been against transgender people and those who do not fit traditional gender stereotypes. Garcia says, "unfortunately, as shown by the news, gay and transgender folks here in Illinois and across the country are too often the victim of brutal hate crimes."Â He also points to the recent murders of Lawrence King in California and Angie Zapata in Colorado as two tragic examples that highlight the dire need for inclusive state and federal hate crime legislation.

Denver Post Shares Moving Story of Family's Loss.
Monica Zapata, the sister of Angie Zapata, an 18-year-old woman who was brutally murdered in her home because she was transgender, shared her story in the Denver Post on October 7. In "Ten years after Matthew Shepard, no change," Monica paints a moving portrait of her sister Angie and the ramifications her murder has had on her family and friends. She calls upon readers to stop hate crimes, pointing out that not enough change has happened since Matthew's death, and that LGBT youth continue to be victims of hate-motivated violence. She says, "My sister and Matthew were both torn down in their prime. At the threshold of their lives, they were brutally torn down and denied the opportunity to achieve their hopes and dreams." Monica highlights the need for federal hate-crimes legislation and reminds readers that the time has come to end violence against LGBT people.

Associated Press Explores Experiences of Gay Seniors
The Associated Pressdrew attention to the estimated 2.5 million gay seniors in America and the challenges they face in an October 4 article titled, "Gay elders' distinctive challenges get a closer look." In his story reporter David Crary highlights the recent partnership between the American Association of Retired Persons (AARP) and Services and Advocacy for GLBT Elders (SAGE), and shares the stories of several LGBT seniors and how they have worked to overcome a lack of familial and institutional support. Ruth Juster, an 85-year-old lesbian Crary profiles, illuminates the need for increased outreach to gay and lesbian seniors, explaining, "Society looked down on us. A lot of people remained under the influence of that prejudice and kept their lives secret. We have to reach these seniors and let them know life is much different now. You have to speak up."

"Choice" Issue Debunked Los Angeles Times
Following Vice-Presidential candidate Sarah Palin's comments prior to the election implying that being gay is a "choice," the Los Angeles Times published an October 8 opinion piece by Nathaniel Frank titled, "Gay is a choice?" Frank, of the Michael Palm Center, a public policy group that works on LGBT issues, debunks the legitimacy of the choice argument. He says, "calling homosexuality a choice is the time tested way politicians signal their belief that it is the wrong choice." On Palin's assertion that her gay friend has made a choice to be gay, Frank writes, "if Palin's gay friend is like other gays and lesbians, her sexual orientation is neither a choice to be tolerated nor a sentence to be served. It's an expression of her freedom to be herself, a freedom that, as Palin said in the debate, 'is always just one generation away from extinction.'" Frank's op-ed is a reminder that rhetoric that inaccurately suggests sexual orientation is a choice can be used as a justification for discrimination and intolerance towards LGBT people.

Radio Station Gives Anti-Gay Activist Platform to Attack Transgender Youth
Kentucky News Talk radio station WKYX's gave Richard Nelson of the anti-gay group The Family Foundation of Kentucky a platform on the outlet's website to perpetuate misinformation about medical care for transgender youth. Nelson made a baseless and fallacious attack on Dr. Norman Spack, a pediatric endocrinologist in Boston who provides care and treatment to transgender youth. Nelson falsely claims both that the treatment is permanent and makes the false assertion that it is "the first step necessary for a sex-change operation." Expressing a blatant disregard for the struggles transgender children encounter, Nelson dispassionately states, "When little Johnny comes in for a checkup wearing a dress and women's jewelry, has it ever occurred to anybody, including his parents, that he should be told to wear pants and stop playing with Barbies?" These kinds of uninformed attacks disregard the expertise of medical and psychological professionals, and only serve to perpetuate distortions and fear of transgender people.

Harsh Words, No Action
I wanted to post this here because I thought it was very interesting and I think that many people have forgotten our history. What is the best way to fight those who hate people, but to expose their lies with the truth.
David Duke and his White Nationalist like to blame most of our problems on the Jews, Blacks, and other non whites. Just the 30 minutes I listened to his Euro Conference this weekend was about the Jews and how they hate white people and don’t consider us human beings. I think his story was if a Jewish person needed a liver that he wouldn’t hestiate to grab a Non Jew off the street and take his liver. I know they won’t consider that hate speech or anything wrong with implying that we have to be afraid of the Jews in our midst, but I do find it very hateful and spreading lies as truth.
That is exactly what the Hitler and this Third Reich did in Germany. They poisoned the minds of the German people by telling them all these terrible lies as truth. I still have nightmares just thinking of the movie the Eternal Jew which is promoted as the truth in White Nationalist circles and families. The scene where the baby calfs were tortured and the movie said that is the way Jewish people butcher their cows for beef really got me angry. I love animals and I thought how could anyone be so cruel to animals. It was the German people love animals and are good and the Jews are terrible and are out to get the German Aryan race. The movie is presented as the truth. I see that same brainwashing going on in this country today.
I had never heard of the book the The Protocols of the Learned Elders of Zionism until I was living with Jeff. It was one of the books on the required reading material. Again that book is passed off as the truth. It is a lie, but like the movie the eternal jew people who are being recruited into White Nationalism are told that is the truth and come to think that they must fear the Jew who they are told is out to destroy them. It was just another book to me that I couldn’t get through because it make me sick to my stomach, but just told Jeff I read it.
Kristallnach did happen, though I know White Nationalists either deny it or blame the Jews and look at it as Germans just defending themselves or some delusion that they hold as the truth.

For those of us engaged in the fight against anti-Semitism, the commemoration of Kristallnacht which took place 70 years ago on November 9-10, has special meaning. Of course, Kristallnacht is important to remember because it was the moment when it became clear that Nazi hatred of Jews was beyond anything seen before. It is important to remember because there are yet those among us who lived through, witnessed it, and survived it. And it is important to remember because after Kristallnacht, the world no longer had any excuses for not acting against the barbarism of Nazi anti-Semitism.
Most of all, however, Kristallnacht teaches us the most basic lesson about how to view anti-Semitism and other forms of hatred. One could ask the question: if we observe Yom HaShoah every spring, why do we need to have a second commemoration every year on the anniversary of Kristallnacht? The answer, I believe, lies in the different focus. Yom HaShoah speaks to the horror of the murder of six million. It remembers and calls attention to the ultimate brutality that humans are capable of and that the history of anti-Semitism eventually produced. It is about remembering the millions of people whose lives were snuffed out because of hatred. And it reminds us that “Never Again” must be a guiding principle of our lives as Jews.
Kristallnacht, on the other hand, is not about the end product of hate but the process. It represents the reality that a Holocaust does not just happen; it has to be prepared, cultivated, acted upon first in small steps, then bigger ones, and finally the biggest. In this sense, Kristallnacht commemoration is not only about remembering the over 90 Jews who were killed, the 30,000 male Jews who were arrested and sent to concentration camps, the over 1,000 synagogues which were torched along with their Torah scrolls and prayer books, and the 7,000 Jewish shops and business that were looted and destroyed.
It is also about how the Holocaust came to pass. It reminds us that the Holocaust couldn’t have happened had there not been 2,000 years of demonization of Jews throughout Europe, as reflected in the Decide charge and in the scapegoating of Jews as an evil and powerful force. It couldn’t have happened had there not been cynical anti-Semites who produced the infamous forgery The Protocols of the Learned Elders of Zionism which gave credibility to the notion of worldwide Jewish satanic power.

Hatred in its most extreme form, like the Holocaust, evolves over time. The challenge is not to wait to stand up until the final stage when it is too late. The time to stand up is during its evolution, indeed as early as possible. Kristallnacht was the moment when the world had to stand up. It didn’t.
There was no doubt from that point on that the Nazis were no longer content to simply strip Jews of their legal rights. Many newspapers and government officials around the world decried the violence and barbarity of Kristallnacht, but few governments were prepared to act.
Franklin Roosevelt condemned the outrages and recalled the US Ambassador from Germany for “consultations,” but any liberalization of America’s tight immigration quotas was, he said, “not in contemplation.” The British cabinet allowed 10,000 Jewish children into Britain from December 1938 to September 1939 in the course of the famous Kindertransport, but refused to allow 21,000 more into Palestine.
Kristallnacht proved the point. The world responded with harsh words and no action. Soon enough, the words themselves echoed empty and hollow. Silence followed. Kristallnacht was the first nail in the coffin of European Jewry.
Kristallnacht commemorations are important for many reasons, including the need to show the world that we must stop hate in its tracks before it leads to the ultimate - a final solution.
